Magistrate Court

The primary responsibilities of the Magistrate Judges are to determine probable cause, read the defendant their rights, and issue warrants in criminal cases. The Magistrate may also set, issue, and enforce bail conditions. The Magistrate Court does not determine guilt or innocence in criminal cases. Our Judges and staff are committed to the concepts of excellence, fair justice and mutual respect.

What do I do if I am given a Cite and Release citation?

On your appearance date, you will report to the Hays County Jail located at 1307 Uhland Road, San Marcos TX 78666. You will appear at the Jail Lobby by 8:00 AM and inform the staff you are present. Later all persons appearing that day will be taken to an area where you can be photographed and fingerprinted. Afterwards you will be taken to the conference room to wait for the Magistrate Judge.
